Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Lovity mobile application, website, and any related features, content, or services we provide (together, the “Service”). By creating an account or otherwise using the Service, you agree to these Terms and form a binding agreement with the entity that operates Lovity in your jurisdiction (“Lovity”, “we”, “our”).

If you do not agree with any part of these Terms, you must not use the Service. We may update these Terms from time to time; material changes will be announced in-app or by email at least thirty (30) days before taking effect, except where a shorter notice period is required by law.

To use the Service you must be at least 18 years old, legally able to enter into a binding contract, and not barred from receiving services under applicable law. You may only create one personal account, and that account is for your individual, non-commercial use.

You agree that you will not:

• Misrepresent your identity, age, gender, location, or relationship status, or impersonate another person.
• Upload content that is unlawful, defamatory, sexually explicit involving minors, harassing, hateful, or that infringes another person’s rights.
• Use the Service to solicit money, recruit for any commercial venture or pyramid scheme, or send spam.
• Probe, scan, scrape, or otherwise attempt to extract data from the Service in bulk, or interfere with its normal operation.
• Reverse engineer, decompile, or attempt to obtain the source code of any part of the Service, except where applicable law expressly permits.
• Use the Service to stalk, threaten, or otherwise harm another person.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

The Service contains three categories of content: (a) content provided by Lovity, including the application itself, design, copy, logos, and curated material (“Lovity Content”); (b) content uploaded or generated by you, including your profile, photos, questionnaire answers, and chat messages (“Your Content”); and (c) content provided by other users (“Member Content”).

You are solely responsible for Your Content and the consequences of sharing it. Do not upload anything you do not have the right to share. Do not share another person’s images, personal data, or private communications without their consent.

We expect every member to behave with respect. Conduct that we consider inappropriate includes harassment, hateful speech, non-consensual sharing of intimate content, doxxing, threats, sexual content involving minors, and attempts to deceive other users for financial gain.

If you encounter a profile or message that violates these Terms, you can report it from the user’s profile or directly within the conversation. We review reports and may, at our discretion, remove content, warn the user, restrict features, or terminate the offender’s account.

Our collection and use of your personal data is described in our Privacy Policy. Please read it so you understand what we collect, why we collect it, and the rights you have over your data.

Subject to your continued compliance with these Terms, Lovity grants you a personal, worldwide, non-transferable, non-exclusive, revocable license to access and use the Service for your private, non-commercial use. This license does not include the right to copy, modify, distribute, sell, or create derivative works based on the Service or Lovity Content.

By submitting Your Content to the Service you grant Lovity a worldwide, royalty-free, sublicensable, transferable license to host, store, copy, display, adapt, translate, and otherwise use Your Content for the purpose of operating, providing, and improving the Service, and for moderation, safety, and analytics. This license ends when you delete Your Content or delete your account, except that (a) we may retain copies as necessary for legal compliance or to enforce these Terms, and (b) content you have shared with other users may persist in their conversations or backups.

You also grant us permission to use the prompts, messages, and questionnaire data you submit to the AI features (such as compatibility scoring and bot replies) in order to generate responses and improve those features. You can opt out of AI features by avoiding the paid AI modules.

Some features of the Service require payment, including credit packs, feature unlocks (such as AI Compatibility), gifts, and any subscription plans we offer (“Paid Features”). Prices are shown in the in-app store and may vary by region, promotion, or platform.

Credits are non-transferable and have no cash value. They are consumed when you use the corresponding paid feature. Unless required by law, used credits and one-time purchases are non-refundable. Refund eligibility is described in our Refund Policy.

If we offer auto-renewing subscriptions, you authorize us (or the applicable app-store provider) to charge the payment method on file at the start of each renewal period until you cancel. You can cancel a subscription at any time from your account settings (or, for app-store subscriptions, from the relevant store), effective at the end of the current billing period.

You can delete your account at any time from your account settings. Deletion is permanent: your profile, photos, messages, and any unused paid balance will be removed in line with our Privacy Policy retention rules.

We may suspend, restrict, or terminate your access if we reasonably believe you have violated these Terms, created a risk to other users, or engaged in conduct that exposes Lovity to legal liability. Where possible and not prohibited by law we will explain the reason and any path to reinstatement.

Lovity does not currently conduct criminal background checks or formal identity verification on its members. You are responsible for taking reasonable precautions in your interactions with other users, both online and in person. Treat the safety guidance available in the app as a baseline, not as a guarantee.

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, nor that any matches, compatibility scores, or AI-generated content will be accurate, useful, or appropriate for you.

Lovity is not responsible for the conduct of other users, whether online or offline, and you use the Service at your own risk.

We respect intellectual property rights. If you believe content on the Service infringes a copyright you own or control, please send a written notice including (a) a signature of the rights-holder or authorised agent, (b) identification of the work claimed to be infringed, (c) the location of the allegedly infringing material in the Service, (d) your contact information, (e) a statement that you believe in good faith that the use is not authorised, and (f) a statement under penalty of perjury that the information is accurate and that you are the rights-holder or authorised to act on their behalf.

The Service may contain links to third-party websites or display advertisements. We do not control and are not responsible for the content, practices, or accuracy of third parties. Your interactions with any third party are between you and that third party.

To the maximum extent permitted by law, Lovity and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Where liability cannot be excluded under applicable law, our aggregate liability to you for all claims arising from or relating to the Service is limited to the greater of (a) the amount you paid Lovity in the twelve months preceding the claim, or (b) one hundred US dollars (USD 100).

We hope to resolve any disagreement directly. Please contact us first at the support address listed below and give us a reasonable opportunity to respond. If we cannot resolve the matter informally, any remaining dispute will be settled by binding arbitration on an individual basis, where such arbitration is enforceable in your jurisdiction. You waive any right to participate in a class action against Lovity to the extent permitted by law.

Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction to protect its intellectual-property rights.

These Terms are governed by the laws of the jurisdiction in which the Lovity entity contracting with you is established, without regard to its conflict-of-laws rules. Mandatory consumer-protection rules of your country of residence continue to apply.

Subject to Section 15 (Dispute Resolution), any judicial proceeding permitted under these Terms will be brought in the competent courts of the jurisdiction whose law governs these Terms, and both parties consent to the personal jurisdiction of those courts.

You agree to indemnify and hold harmless Lovity, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of (a) Your Content, (b) your use of the Service, (c) your breach of these Terms, or (d) your violation of any third-party right.

By creating an account or using the Service you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them. If you have any questions, please contact support before continuing to use the Service.
